Terms of Service

By creating an account, accepting an invitation, or using FormEsque, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent. You must be legally able to enter a binding agreement and have authority to act for that organization.

FormEsque is intended for business use. It is not directed to children and may not be used by anyone under 18.

You are responsible for accurate account information, protecting credentials, assigning appropriate roles, promptly removing former personnel, and all activity performed through your organization. Shared credentials are not permitted.

Organization owners and administrators control company and workspace configuration, member access, documents and business records. Your organization is responsible for resolving internal authority disputes and keeping its designated owner current.

You retain ownership of documents, templates, customer information, branding and other content submitted to FormEsque. You grant FormEsque a limited right to host, process, transmit, reproduce and format that content only as needed to provide, secure and support the service.

You represent that you have the rights and lawful basis needed to upload and process the content, contact recipients, request signatures, issue invoices and direct FormEsque to act on your behalf. You are responsible for the accuracy and legal sufficiency of your documents, prices, taxes, notices and business terms.

FormEsque provides tools to present records, collect signer actions and retain supporting evidence. Electronic signatures may create binding obligations. You are responsible for deciding whether a transaction may be signed electronically, identifying required disclosures and obtaining all necessary consent.

FormEsque is not a law firm, notary, certificate authority or legal adviser and does not guarantee that any document, signature method or workflow satisfies a particular law, regulator, court or transaction requirement. Additional terms appear in the Electronic Signature Disclosure.

You may not use FormEsque to violate law, infringe rights, mislead recipients, interfere with service operation, bypass usage or permission controls, probe another tenant, distribute malware, send unlawful messages, or process content for which you lack authorization.

• Do not attempt to enumerate identifiers, access another workspace, reverse engineer security controls or obtain credentials.
• Do not upload malicious code, illegal content, highly regulated data that FormEsque has not agreed in writing to support, or material that creates unreasonable risk.
• Do not use automated traffic that degrades service or exceeds documented limits.

Plan features, limits and prices are shown at purchase or in an order form. Paid charges are due as stated at checkout and may be subject to taxes. Unless otherwise stated, subscriptions renew for the selected billing period until canceled.

FormEsque may improve, replace or discontinue features. We will use commercially reasonable efforts to provide advance notice of a material reduction to paid core functionality when practical. Beta, preview and future features may change or be withdrawn and should not be relied on for critical obligations.

FormEsque depends on service providers for hosting, authentication, databases, storage, email, maps and optional AI features. Their availability and processing may affect FormEsque. Your separate use of third-party products is governed by their terms.

FormEsque is not responsible for third-party services outside our reasonable control, but we remain responsible for selecting and managing subprocessors as described in our Privacy Policy and Subprocessor List.

We may limit or suspend access when reasonably necessary to prevent harm, address unlawful use, protect another tenant, respond to a legal requirement, resolve nonpayment or contain a security incident. When practical, we will notify the organization and limit the action to the affected area.

You may stop using the service or cancel according to your plan. Following termination, access and data handling are governed by the Data Retention Policy, applicable law and any service agreement. Signed and audit records may be retained when necessary to preserve transaction evidence or meet legal obligations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMESQUE IS PROVIDED ON AN AS-AVAILABLE BASIS. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL OR DATA. FORMESQUE'S AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID OR PAYABLE FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. These limits do not apply where prohibited by law or to obligations that cannot legally be limited.

The governing law, venue and dispute procedure in an applicable order form or service agreement control. If none exists, the law and courts applicable to the FormEsque contracting entity apply, without regard to conflict-of-law rules. Neither party may assign these Terms without consent except as part of a merger, reorganization or sale of substantially all relevant assets.

If a provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. We may update these Terms and will post the revised date; material changes apply prospectively after reasonable notice. General questions can be initiated through the public FormEsque support form. Formal legal notices must use the notice method identified in the applicable account, order form, or service agreement.
