Electronic Signature Disclosure

This disclosure explains consent to electronic records and signatures, the technology required and how to request another delivery method.

The business that sent you a document is the party to the underlying transaction. FormEsque provides the technology and is not a party to that agreement unless expressly stated.

1. Consent to electronic records

By selecting the consent checkbox and applying an electronic signature, you agree to receive, review, sign and retain the presented documents electronically. You understand that an electronic signature is intended to have the same legal effect as a handwritten signature where applicable law permits.

2. Records covered

Your consent covers the proposal, agreement, disclosures, terms, change requests, signature evidence and related records presented in the signing session. It does not automatically apply to unrelated future transactions unless you consent again or another valid agreement provides otherwise.

3. Hardware and software requirements

You need a current web browser with JavaScript and cookies enabled, a reliable internet connection, the ability to open common PDF files and enough device storage or access to email to retain a copy. A phone, tablet or computer with a screen large enough to review the full document may be used.

4. Review and correction

Review every page and confirm your name and contact information before signing. If information is incorrect, do not sign. Use the available request-changes option or contact the sending business so it can issue a corrected record. FormEsque does not alter a completed signed record on the sender's behalf.

5. Paper copies and withdrawal

Before signing, you may decline electronic delivery and ask the sending business whether a paper or alternate method is available. Withdrawing consent may delay the transaction and does not invalidate electronic records or signatures already completed. The sender may charge a disclosed, lawful fee for paper delivery.

6. Keeping copies and updating contact details

Download or print the completed record when offered and retain it for your files. Tell the sending business promptly if your email address or other contact information changes. Access to a public signing link may expire after completion or for security reasons.

7. Attribution and evidence

The signing workflow may record the typed name, drawn signature, consent action, timestamps, network and browser-related evidence, document version and integrity identifiers. These records are used to attribute the action, preserve the completed document and investigate disputes or security events.

8. Questions

Questions about the document, legal terms, withdrawal or paper delivery should be directed to the business that sent the document. Questions about FormEsque technology should be submitted through the support channel identified in the signing experience or service agreement.
